ArcusOffice Terms of Service

Effective date: 4 November 2026

1. Acceptance of these terms

These Terms of Service ("Terms") govern access to and use of ArcusOffice (the "Service"), a cloud-based customer relationship management (CRM) service operated by Arcus Cloud Computing Pty Ltd (ABN 21 689 646 955, ACN 689 646 955) ("Arcus Cloud Computing", "we", "us", or "our"). By accessing or using the Service, you agree to these Terms. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept these Terms for that organisation, and "you" includes that organisation ("customer organisation"). These Terms apply to the Service only; our website Terms and Conditions of Use apply to the Arcus Cloud Computing website.

2. The Service and beta status

ArcusOffice is currently in a private, invite-only beta. Beta access is by invitation only, offered to selected individuals and organisations at Arcus Cloud Computing's discretion, and may be withdrawn at any time. During the beta the Service is provided "as is" and "as available". Features may be added, changed or removed, and the Service may contain errors or be interrupted. We will try to give reasonable notice of significant changes that affect how you use the Service.

3. Accounts and organisation administrators

  • Each user must have their own account and must keep their login details confidential.
  • Each customer organisation has one or more organisation administrators. Administrators are responsible for inviting and removing users, assigning roles and permissions, enabling modules, and connecting any third-party services (such as a Google account for email sending) on behalf of the organisation.
  • The customer organisation is responsible for the activity of its users in the Service and for ensuring that the information it enters is accurate and lawfully collected, including giving any notices and obtaining any consents required to store its contacts' personal information in the Service.
  • Please email michael@arcuscloudcomputing.com.au promptly if you suspect unauthorised use of an account.

4. Acceptable use

You must not use the Service to:

  • store, send or share content that is unlawful, defamatory, harassing, infringing or otherwise objectionable;
  • send spam or unsolicited commercial electronic messages. All email sent from the Service must comply with applicable anti-spam laws, including the Spam Act 2003 (Cth) - for example, commercial messages must be sent with consent, identify the sender and include a working unsubscribe facility;
  • attempt to access, or interfere with, another organisation's data or account, or any part of the Service you are not authorised to access;
  • probe, scan or test the vulnerability of the Service, or circumvent its security or tenant isolation, without our written permission;
  • upload viruses, malware or other harmful code, or place an unreasonable load on the Service; or
  • breach any applicable law or the rights of any other person.

We may suspend access that we reasonably believe breaches this section, and we will tell the organisation administrator where it is practical to do so.

5. Your data

The customer organisation owns the data it and its users put into the Service ("customer data"). You grant us a limited, non-exclusive licence to host, copy, process, transmit and display customer data only as needed to provide, secure, support and maintain the Service for you, and as required by law. We handle customer data as described in the ArcusOffice Privacy Policy. We do not sell customer data.

Arcus Cloud Computing owns the Service itself, including its software, design and branding. These Terms do not transfer any of our intellectual property to you, other than the right to use the Service in accordance with these Terms.

6. Third-party services

The Service relies on, and can optionally connect to, third-party services, including Google (for example Gmail or Google Workspace for sending email), and Amazon Web Services (for file storage). Where an organisation connects a third-party service such as accounting software in future, that connection will be optional and at the organisation's choice. Your use of a connected third-party service is also subject to that provider's own terms and privacy policy. We are not responsible for third-party services, and a third-party service may change or stop in a way that affects features of the Service that depend on it.

7. Availability and support

During the beta we provide the Service and support on a best-efforts basis. We do not guarantee any particular level of availability, and there may be planned or unplanned downtime. We recommend that you keep your own copies of any information that is critical to your business.

8. Fees

Beta access is free of charge for invited participants. Free access may be withdrawn at any time. Any future paid plan would be offered under separate terms, with notice to organisation administrators before it applies. We will not charge you for the Service without your agreement.

9. Termination, export and deletion

You may stop using the Service at any time. We may suspend or end your access if you materially breach these Terms, if required by law, or if we end the beta or the Service, in which case we will give reasonable notice where we can. An organisation administrator can request an export or deletion of the organisation's data at any time by emailing michael@arcuscloudcomputing.com.au. On account closure or a deletion request, we delete the organisation's data from live systems within 30 days, and it is purged from backups within a further 90 days as backups rotate (fully removed within 120 days), except limited records we must keep by law (for example tax or billing records). See the ArcusOffice Privacy Policy for details.

10. Disclaimer and limitation of liability

Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by law (including the Australian Consumer Law) that cannot lawfully be excluded or limited.

Subject to that, and to the maximum extent permitted by law:

  • the Service is provided "as is", and we exclude all other warranties, conditions and guarantees, including as to merchantability, fitness for a particular purpose and uninterrupted or error-free operation;
  • we are not liable for any indirect or consequential loss, or for any loss of profits, revenue, data or goodwill, arising out of or in connection with the Service or these Terms; and
  • where our liability for a failure to comply with a consumer guarantee cannot be excluded but can be limited, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date and, for significant changes, notify organisation administrators. Continued use of the Service after a change takes effect means you accept the updated Terms.
